Oryx Health Holdings (Pty) Ltd, trading as Oryx ("Oryx", "we", "us", "our"), Reg. No. 2026/366283/07, is a company registered in South Africa at Level 3A, Pearls Mall, Umhlanga, KwaZulu-Natal, 4319. We operate the website www.oryx.health (the "Site") and the Oryx Health website application (the "App") (together, the "Services").
These Terms of Use govern your access to and use of the Services. Three other documents form part of this agreement and are incorporated by reference: the Oryx Privacy Policy (the "Privacy Policy"), the Oryx Returns & Refunds Policy (the "Returns & Refunds Policy"), and the Oryx Informed Consent to Telehealth Treatment (the "Informed Consent"). Together with these Terms of Use, they form the entire agreement between you and Oryx regarding your use of the Services (collectively, the "Agreement"). Terms defined in any one of these documents carry the same meaning in each of them.
By accessing or using the Services you confirm that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree, you must not use the Services.
Some of the provisions below limit our liability, create obligations or risk for you, require you to indemnify us, or record an acknowledgement by you of a fact. We draw these to your attention because they are important. Read them carefully before continuing.
We will give you prior notice of any material change to these terms, either by posting a notice on the Services or by emailing the address on your account. Continued use of the Services after that notice takes effect means you accept the change.
Certain eligibility criteria, including that you are 18 years or older, male, and a resident of South Africa, are applied automatically during the registration process. If you are excluded from the Services by this automated screening, you may request that a person at Oryx review the decision by contacting us at support@oryx.health. This right is provided in accordance with section 71 of the Protection of Personal Information Act 4 of 2013 ("POPIA").
Nothing on the Services constitutes an advertisement for, or a claim about, a scheduled substance beyond what the Medicines and Related Substances Act 101 of 1965 and its regulations permit. Product information is provided for your general understanding only and does not replace the advice of your treating practitioner.
These terms are governed by the law of South Africa. You and Oryx consent to the non-exclusive jurisdiction of the High Court of South Africa, KwaZulu-Natal Division, Durban, for any dispute arising from these terms or your use of the Services.
Nothing in these terms limits your right to approach the National Consumer Commission, the Consumer Goods and Services Ombud, or any other forum available to you under the Consumer Protection Act 68 of 2008 ("CPA"). The provisions of the CPA that apply to electronic transactions apply to your use of the Services to the extent required by law. Nothing here is intended to unlawfully restrict any right or obligation created for you or for Oryx under the CPA.
The Services are provided voetstoots ("as is"). Your use of them is at your own risk. We do not guarantee that the Services will be uninterrupted, error-free, or free of viruses. We make no representation as to the completeness or accuracy of general information published on the Services, save where the CPA prevents us from excluding such a representation.
You agree to use the Services lawfully, for your personal and non-commercial use only, and not to:
To the extent permitted by the CPA, you indemnify us against loss we suffer as a direct result of your breach of this section or your unlawful use of the Services. This indemnity does not apply to loss arising from our gross negligence, fraud, or wilful misconduct, or to any liability that cannot lawfully be excluded.
All content on the Services, including text, graphics, logos, and the Oryx name and marks, belongs to or is licensed to Oryx and is protected by copyright and trademark law. You may view and download content for personal, non-commercial use only. No other use, reproduction, or distribution is permitted without our prior written consent.
The Services may link to third-party websites for your convenience. We do not review, endorse, or accept responsibility for the content or practices of those websites. Use of them is at your own risk and subject to their own terms.
Oryx makes no express or implied warranty as to the continued availability of the Services, the accuracy or currency of their content, or the outcome of any treatment or product recommended through them. This does not affect any warranty that cannot lawfully be excluded under the CPA or other Applicable Law (a "non-excludable condition"). Where a non-excludable condition applies, nothing in this section limits it.
Oryx's total liability to you for any claim arising from your use of the Services, other than a non-excludable condition, is limited to the amount you actually paid to Oryx for the product or service giving rise to the claim. This is subject to the CPA.
We are not liable for indirect, consequential, or special damages, including loss of profit or data, even if we have been advised such loss was possible. This limitation does not apply to: (a) loss caused by our gross negligence, fraud, or wilful misconduct; (b) liability for death or personal injury caused by our negligence; or (c) any liability that cannot lawfully be excluded under the CPA or other applicable law.
Oryx is a facilitation platform for telehealth services. Any subscription fee you pay is for the ongoing supply of prescribed products and consultations, not a premium as defined in the Medical Schemes Act 131 of 1998. Oryx is not a medical scheme and is not registered with, or regulated by, the Council for Medical Schemes.
By using the Services, you acknowledge that Oryx processes your personal information, including health information where applicable, as described in the Privacy Policy. This processing may involve the use of third-party service providers and, where necessary, the transfer of your personal information outside South Africa in accordance with the safeguards required by POPIA section 72. For the purposes of POPIA, Oryx is the responsible party for your personal information. Full detail on how your information is collected, used, shared, and protected is set out in the Privacy Policy.
By registering for the Services, you consent to receiving transactional and service-related communications from Oryx electronically, including booking confirmations, order notifications, dispatch updates, and account alerts. These communications are necessary for the provision of the Services and do not constitute direct marketing as contemplated in section 69 of POPIA. You may manage your direct marketing preferences separately, as described in the Privacy Policy.
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Do not share your password or allow another person to access your account. If you become aware of any unauthorised access to, or use of, your account, you must notify us immediately at support@oryx.health. Oryx is not liable for any loss arising from your failure to keep your credentials secure or from unauthorised use of your account that you have not reported.
For security purposes, your session on the Services will automatically expire after 10 minutes of inactivity. You will need to log in again to continue using the Services.
The Services constitute an electronic transaction as contemplated in the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"). In compliance with section 43 of ECTA, we confirm the following:
If you believe that any content on the Services infringes your rights, you may submit a notice of infringement in terms of section 77 of ECTA to support@oryx.health. Your notice must include your full name and contact details, a description of the work or right allegedly infringed, the location of the infringing material on the Services, and a statement that you have a good-faith belief that the use is not authorised. We will respond to valid notices in accordance with ECTA.
Oryx is not liable for any delay or failure to perform its obligations under these terms where that delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disaster, pandemic, epidemic, power failure, internet or telecommunications outage, fire, flood, war, civil unrest, government action, labour dispute, or failure of a third-party service provider. We will take reasonable steps to minimise the effect of any such event and will resume performance as soon as reasonably practicable.
Oryx is committed to making the Services accessible to all users, including persons with disabilities. We continually work to improve the accessibility of the Site and App in line with recognised accessibility standards. To purchase through the Services you must meet the eligibility requirements in section 3 and hold a valid payment method in your own name. For any prescription product, you must also hold a valid prescription issued through Oryx, as described in the Informed Consent. Non-prescription wellness or supplement products may be purchased without a prescription but remain subject to the eligibility and use restrictions in this Part B.
We try to keep product descriptions, images, and prices accurate and current, but we do not guarantee this. Products are subject to availability, and we may discontinue any product at any time. This applies to every product we sell now or introduce in future. Non-prescription wellness and supplement products sold through the Services are not intended to diagnose, treat, cure, or prevent any disease, see Part D of these Terms of Use for full detail.
You can review your order before confirming it. No contract is formed until we dispatch the goods or begin the consultation you have booked. We may decline or cancel an order where, among other things: a product is out of stock; we cannot verify payment; you do not hold a valid prescription for a prescription product; we suspect fraud; or there is a pricing or product error. If we decline or cancel an order, we will notify you and refund any payment already made.
We may cancel or refuse any order, or limit quantities, where we reasonably believe it is fraudulent, made by a reseller, or in breach of these terms. Where a payment is disputed with your card issuer without you first contacting us to resolve the matter, we may pursue recovery of any resulting loss from you, including reasonable costs of collection.
Ownership of goods passes to you on the later of dispatch or full payment. Risk in the goods passes to you on delivery.
Delivery times shown at checkout are estimates only. Orders may be delivered in more than one parcel, and split shipments may arrive separately, each with its own tracking number. We do not dispatch orders on Thursdays or Fridays, so that nothing sits in transit over a weekend. Products requiring cold-chain handling are delivered subject to the additional conditions set out in the Returns & Refunds Policy.
Please inspect your order on delivery. If anything is missing, damaged, or incorrect, contact us at support@oryx.health within 48 hours, or within the shorter window set out in the Returns & Refunds Policy for cold-chain products.
The Returns & Refunds Policy governs returns, refunds, and replacements. The Privacy Policy governs the collection and use of your personal information, including health information. The Informed Consent governs your relationship with your treating practitioner and your consent to treatment. All three are incorporated into these Terms of Use by reference.
What you read on the Site and App is general information only. It is not medical advice, a diagnosis, or a substitute for seeing a qualified healthcare professional. Never ignore or delay professional medical advice because of something you read here. This does not apply to a personalised treatment plan your practitioner gives you after a consultation. That is clinical advice specific to you, and the Informed Consent governs it.
Individual results vary. Oryx makes no representation, warranty, or guarantee about treatment outcomes, hormone optimisation, weight loss, hair restoration, sexual health, performance, or any other result you may see referenced on the Services. Past results are not a guarantee of future outcomes.
Oryx is not for emergencies. If you believe you are experiencing a medical emergency, contact emergency services or go to your nearest emergency room immediately. Do not wait for an Oryx consultation.
